Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Azaman mobile application, website at https://www.azaman.me/, and related products and services (collectively, the "Services") provided by Azaman ("Azaman," "we," "us," or "our"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

To use the Services, you must:

• Be at least 18 years old and legally capable of entering into a binding contract
• Be a resident of a country where the Services are available
• Provide accurate, complete, and current registration information
• Not be prohibited from using financial services under applicable law

We may refuse, suspend, or terminate access if you do not meet eligibility requirements or if we suspect fraud, misuse, or regulatory non-compliance.

2. Account Registration and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately atsugru@azaman.me if you suspect unauthorized access.

We may require identity verification (KYC) and additional documentation to comply with anti-money laundering, counter-terrorism financing, and other regulatory obligations. Failure to complete verification may limit or suspend your access to certain features.

3. Description of Services

Azaman provides digital financial and commerce services that may include, where available:

• Sending and receiving money
• Savings and locked savings features
• In-app payments and checkout with participating merchants
• Virtual or physical payment cards
• Group savings (including Susu-style features)
• In-app messaging related to orders and transactions
• Marketplace or merchant discovery features

Features may vary by location, account status, and partner availability. We may add, modify, or discontinue features at any time.

4. Financial Services and Third-Party Partners

Certain Services are provided in partnership with licensed banks, payment institutions, mobile money operators, card issuers, or other regulated entities. Your use of those Services may also be subject to their terms and policies.

Azaman is not a bank unless expressly stated in a separate agreement. Funds held in connection with the Services may be maintained with regulated partners subject to applicable safeguarding requirements.

5. Fees and Limits

Fees, exchange rates, transaction limits, and applicable charges will be disclosed in the app before you confirm a transaction, unless otherwise required by law. We may change fees and limits with reasonable notice where permitted.

You authorize us and our partners to debit applicable fees from your account balance or linked payment method.

6. Acceptable Use

You agree not to:

• Use the Services for unlawful, fraudulent, or unauthorized purposes
• Provide false, misleading, or incomplete information
• Attempt to interfere with, disrupt, or reverse engineer the Services
• Use the Services to launder money, finance terrorism, or evade sanctions
• Harass, abuse, or defraud other users or merchants
• Circumvent security, verification, or transaction limits
• Use the Services on behalf of a third party without authorization

We may investigate violations and cooperate with law enforcement or regulators as required.

7. Transactions and Disputes

You are responsible for reviewing transaction details before confirming a payment or transfer. Once authorized, transactions may be irreversible except where required by law or partner policy.

Disputes with merchants or other users should first be addressed through in-app communication where available. We may assist with dispute resolution but are not responsible for goods or services provided by third parties.

8. Savings, Cards, and Locked Features

Savings, locked savings, and card features may include specific terms shown at the time of activation, including withdrawal restrictions, fees for early access, spending limits, and expiration rules. By enabling these features, you agree to those additional terms.

9. Intellectual Property

The Services, including software, design, trademarks, logos, and content, are owned by Azaman or its licensors and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Services for personal, lawful purposes in accordance with these Terms.

10. Electronic Communications

You consent to receive communications electronically, including account notices, transaction confirmations, security alerts, and legal disclosures. Electronic communications satisfy any legal requirement that such communications be in writing.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted, error-free, or secure operation of the Services. Availability may be affected by maintenance, network issues, partner outages, or events beyond our reasonable control.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AZAMAN AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT OF FEES YOU PAID TO US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY APPLICABLE LAW.

13. Indemnification

You agree to indemnify and hold harmless Azaman and its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

14. Suspension and Termination

We may suspend or terminate your account or access to the Services at any time if we reasonably believe you have violated these Terms, pose a security or legal risk, or if required by law or a partner institution.

You may close your account by contactingsugru@azaman.me, subject to settlement of outstanding transactions and legal retention requirements.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Ghana, without regard to conflict of law principles, except where mandatory local consumer protection laws apply in your jurisdiction.

Before initiating formal proceedings, you agree to contact us to attempt to resolve the dispute informally. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Accra, Ghana, unless applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the app, website, email, or other reasonable means. Continued use of the Services after the effective date of updated Terms constitutes acceptance.

17. General

• If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
• Our failure to enforce any right or provision is not a waiver of that right or provision.
• You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
• These Terms constitute the entire agreement between you and Azaman regarding the Services.
